The newly revised Implementing Regulations of the Patent Law of the People’s Republic of China will come into effect on January 20, 2024
The latest revised Chinese Patent Law officially came into effect on June 1, 2021. Subsequently, the implementing regulations of the Chinese Patent Law underwent extensive discussions within the industry and solicitation of public opinions. On December 11, 2023, there is a new round of amendments, which will officially take effect on January 20, 2024. This round of amendments covers a wide range of content and represents adjustments and improvements to the existing system. It not only elaborates on newly added provisions to the Patent Law but also aims to align with international treaties. The primary goals are to strengthen patent protection incentives, respond to the needs of innovators, and optimize the patent legal system.
The latest amendments to the implementing regulations related to many aspects, elaborating on the patent term extension system, clarifying the procedures for requesting delayed examination, supplementing rules for Open License and adding special provisions for international design applications and priority rights and so on. These changes hold significant importance in implementing the amendments to the Patent Law.
